Speak to your travel insurers. Suing is unlikely to resolve anything.

However, you agreed to what you would be paid for delayed luggage and you AGREED that the airline would not be responsible for consequential damage, which is what you are asking for. You also AGREED to arbitration. So, you will lose the suit and will have to pay for all the airline's expenses including their very expensive lawyers. You might read what you agree to.

On what grounds do you think you can sue? Because there are none. You should not have put something as essential as your retainers in the checked luggage.

You can sue. Whether you would win is another question.

If you have travel insurance, see if it will cover this. If you do not, then contact the airline and see if it is willing to contribute to the cost of a new set of retainers. They will most certainly want documentation from your dentist/orthodontist indicating that a replacement set is necessary.

For future reference, you should not pack anything that is valuable or necessary (cash, jewelry, electronics, medication, medical supplies) in your checked bag for this very reason.

If your teeth shifted so much in 5 days that your retainer will not fit, you should be JUMPING UP FOR JOY WITH HAPPINESS because you have found out that your teeth shift easily and you can plan for it now.
If you wore braces, they may have been taken off too soon.
It appears that you need permanent retainers for now.
In the future, you will likely need to wear the retainers 3-4 nights a week for the rest of your life (they should be replaced every 10 years or so).
Get back to the orthodontist As soon as possible to get this fixed before it is irreparable.

Just think what could have happened if your retainer had been got 10 days. Your teeth would be shifted all over the place.

If you can shove the retainer back in. It might hurt for a day or two but it will go back into place.

No you can't sue the airline because you put important, expensive items in your checked luggage.
